The Chairperson and Deputy Chairpersons are appointed by the Minister for Justice, Home Affairs and Migration pursuant to section 62(1)(a) and (b) of the International Protection Act 2015 respectively. They serve a five-year term, renewable once.

The Registrar is appointed by the Minister for Justice, Home Affairs and Migration pursuant to section 66(1) of the International Protection Act 2015. The Registrar, in consultation with the Chairperson, is tasked with managing and controlling the staff and administration of the Tribunal, and to perform such other functions as may be conferred on him or her by the Chairperson.

The Tribunal Members are appointed by the Minister for Justice, Home Affairs and Migration pursuant to s. 62(1)(c) of the International Protection Act 2015. The number of Tribunal Members appointed in a whole-time or part-time capacity depends on what the Minister considers necessary for the expeditious performance of the functions of the Tribunal. There are currently six whole-time Tribunal Members, who serve a five year term, which may be renewable once.

Tribunal Members are required to have a minimum of two years experience as a practising barrister or solicitor. The Chairperson and Deputy Chairpersons are required to have a minimum of five years experience.

The administrative staff of the Tribunal are civil servants and are currently assigned to the Tribunal from the Department of Justice, Home Affairs and Migration.
